There were large numbers of Rally photographs received by me – for which I thank the concerned members.
However, there were far too many identical photographs so I did not reproduce all those on "REPORT MY SIGNAL” email.
I hope you appreciate my constraints.

I also wish to thank all the Members of "REPORT MY SIGNAL", their family members and friends, who generously contributed funds for the Sainik Aakrosh Rally and also attended the Rally. Without support from you all – it could not have been such a grand success.

I did recognise very large number of faces in the photographs received by me but time and space did not permit to mention names along with the photographs.

Govt Appoints Justice L Narasimha Reddy to Head Judicial Committee on OROP 
The Central Government has appointed Justice L Narasimha Reddy, retired Chief Justice of Patna High Court to head the Judicial Committee which will look into the implementation of One Rank One Pension (OROP) scheme for the Ex-Servicemen. 

The Terms of Reference for the Committee shall be to examine and make recommendations on references received from the Central Government on the following matters:- 

• Measures for the removal of anomalies that may arise in the implementation of the OROP as notified by the Government on 07 November 2015. 

• Measures for the removal of anomalies that may arise out of inter-services issues of the three forces due to implementation of OROP order as notified by the Government on 07 November 2015. 

•Implications on Service matters. 

•Any other matter referred by the Central Government on implementation of the OROP or related issues. 

In making its recommendations, the Committee shall take into account the financial impact of its recommendations. 

The Committee shall make its recommendation within six months of the date of its constitution. It may, if necessary, give interim reports to the Government on any of the matters related to its terms of reference. 

The Committee will devise its own procedure and may call for such information and take such evidence, as may be considered necessary. Ministries and Departments of Government of India shall furnish such information and documents and other assistance as may be required by the Committee. The Committee will have its Headquarters in Delhi. All administrative support to the committee will be provided by Department of Ex-Servicemen Welfare, Ministry of Defence.

JUDICIAL COMMISSION

Dear Sirs
The first reading indicates that the JUDICIAL COMMISSION will only examine and make recommendations on references received from Central Government.See para 2 sub para i.
Now the only hope is in para 4 where it states the Commission will devise its own procedure and MAY call for such information and take evidence as it may be considered necessary.
However as of now there is enough ambiguity in the notification to ensure ESM and excluded particularly since the Commission is based out of the dreaded DESW
More educated and degree holders may make their own interpretation.
This notification shows nothing that the UFESM(Motley) group was supposed to have been told by FM/RM.
Intelligent veterans make your own valuation of who stands for ESM?

MORNING SHOWS THE DAY

Right from 2013, I never, ever had any doubt that a Govt, headed by a heartless, cunning, power-hungry fraud, was going to be a faud too.

Going by the Terms of Reference of today's notification on the appointment of a Judicial Commission on OROP, for the nth time in the last nineteen months, the Central Govt has unequivocally demonstrated its ability to comit fraud on the Nation. 


Since Sep '15 and thereafter after the OROP notification in Nov '15, the Govt has been untiringly telling the Nation that a small section of the veterans was resorting to agitation, egged on by the political opposition, when they should really have given it up and prepared to discuss their issues with the Judicial Commission that the Govt was going to constitute soon.

No doubt that the Notification has come, but it makes it clear to the Commission that the latter shall consider ONLY those issues that the Govt has referred to it in the Terms of Reference. It leaves no scope for the Veterans organisations to place any point of their own.


Where does it leave the Veterans and their issues with the OROP notification?

That they have appointed a retired High Court Judge, leaves many a question mark. We already have the recent example of the two HC judges, appointed by the BCCI, under the earlier dispenstion, to look into the irregularities, if any and the couple, singly and jointly, did not find a thing amiss. What Justice Mudgal Commission did to their 'authority-favoured' findings, is history. He just shredded them.


At the end of it all, the Govt will go to Town, high on gas and low on content, albeit with the tacit support of some of our own and an imppasively silent set of Chiefs,  proclaiming that the Commission has upheld their version of OROP, and trashed the contention of the agitating Veterans. 

It will, then, continue with its nefarious designs on soldiers with impunity.

And the Nation with the three Service Chiefs looking on uncaringly; or will they.

My Sisters, Brothers Friends and you, the three Chiefs, whose sworn duty is to look after the soldiers under your charge, be they serving, retired or demised, with yout life -

it is upto you now. We the soldiers, the Defenders of the Nation, are looking upto you.

FLASH from JM 

UFESM was preparing to temp suspend protest till FM public statement last night at Agenda # 15 Aaj Tak, claiming most ESM accepted current OROP notification. Today rally str and REPS from 26 states nailed his incorrect statement. 

His Ministry banned publication of our sponsored qr page advt in HT. 

His bias against AFV's and his propping up a section of JAICHANDS exposed . 
As per opinion of large number of Veterans today Govt given two weeks to complete mediatory talks,  failing which one week notice for action as deemed correct not necessarily proper. 

On 14 anniversary of attack on Parliament we send our heartfelt sympathies to those families who lost their all that day. Also we sympathise with the people of Chennai in their hour of trial. 

Also call to ESM across the country to boycott participation in R-day parade & Army Day Parade of 2016.

Actually, there is no mystery. All the facts are recorded and documented. However, in the race to claim credit (and disown criticism), the OROP issue is being presented as a big controversy shrouded in mystery.
Get facts right
Let’s get the facts right. The Indian Armed Forces are voluntary forces. There is no conscription. Men and women join the forces as jawans or officers for a variety of reasons and, among them, is the security of a job. While the job is reasonably secure, it is not a job for the entire working life. According to the report of the Koshiyari Committee, 85 per cent of the Armed Forces personnel retire by the age of 38 years and another 10 per cent retire by the age of 46 years. They have to work for a living for many more years, but there is no guarantee of a post-retirement job.
Retirement at an early age is good and necessary to keep the forces young and fighting fit. Hence the case for an honourable pension.
There is another reason to make pension an attractive term of service that has not been noticed adequately: it is to attract new volunteers. The attrition rates, and the vacancy levels, are alarmingly high and, if the Armed Forces have to remain voluntary forces, recruitment must remain robust. The promise of an honourable pension is an important factor in recruitment.

OROP is an honourable pension. The time to debate the merits and demerits of OROP is over. It was a decision taken by the UPA government and reiterated by the NDA government. Both may share credit.

Some more undisputed facts: While presenting the interim budget for 2014-15 on 17 February 2014, I had said: “During the tenure of the UPA Governments, changes in the pension rules applicable to the defence services were notified on three occasions in 2006, 2010 and 2013. As a result, the gap between pre-2006 retirees and post-2006 retirees has been closed in four ranks (subject to some anomalies that are being addressed): Havildar, Naib Subedar, Subedar and Subedar Major….. Government has therefore decided to walk the last mile and close the gap for all retirees in all ranks. I am happy to announce that Government has accepted the principle of One Rank One Pension for the defence forces.”

What is orop?
On 26 February 2014, the Ministry of Defence defined OROP and the following definition was communicated to the Chiefs of the three Services: “OROP implies that uniform pension be paid to the Armed Forces personnel retiring in the same  rank with the same length of service irrespective of their date of retirement and any future enhancement in the rates of pension to be automatically passed on to the past pensioners. This implies bridging the gap between the rate of pension of the current pensioners and the past pensioners, and also future enhancements in the rate of pension to be automatically passed on to the past pensioners.”

The letter was a 4-page, 12-paragraph letter that left no doubt on what was intended to be done. The conditions, modalities and the manner of implementation were spelt out in detail. On 22 April 2014 a Working Group was constituted with the Controller General of Defence Accounts as the chairperson with Terms of Reference that included “to work out the detailed financial implications.” It was specifically stated that “since substantial increase is anticipated in expenditure on OROP, FA (DS) would thereafter seek additional funds as per requirement.”

Much is made of the fact that the interim budget provided only Rs 500 crore. It was, as I had said, an estimate and the money was provided as “an earnest of the UPA Government’s commitment.”  Mr Arun Jaitley reaffirmed the commitment in his Budget Speech on 10 July 2014. And, pray, how much did he provide? He said, “we propose to set aside a further sum of Rs 1,000 crore to meet this year’s requirement”!
So, why is the Government adding ifs and buts? Why is the Government adding unacceptable riders or conditions that will dilute the “commitment” of two successive Governments?

Reject the objections
The sticking points are entirely due to bureaucratic back-pedalling and the inability of the Government to overrule the objections. The promise must prevail over the objections, even if some of them appear valid. The promise was to implement OROP from 1 April 2014, and not 1 July 2014. The promise was same pension to personnel retiring in the same rank with the same length of service, and not grant of same pension by looking into the cause of retirement.
The promise was that future enhancements in the rate of pension will be automatically passed on to the past pensioners, and not that the adjustment will be made every five years.

OROP is indeed a defined benefit pension and different from the National Pension System (NPS) which is a contributory pension scheme. A person who has a short working life in the Armed Services cannot contribute enough during that period to earn an honourable pension. Hence OROP.

Yesterday they sent off a contingent to Delhi for the rally.
