 Defence Minister Manohar Parrikar was in favour of granting 'One Rank, One Pension' (OROP) to ex-servicemen but pressure was exerted on him by his Cabinet colleagues on the issue, legal luminary Ram Jethmalani on Monday claimed even as he launched a scathing attack on Prime Minister Narendra Modi.

Jethmalani, a supporter-turned-critic of Modi and a former BJP leader, said apart from failing to deliver on his electoral promise of bringing back black money stashed abroad, Modi has not been able to deliver on the OROP issue.

Ex-servicemen have been staging protests at Jantar Mantar in New Delhi for the past 176 days, demanding OROP.

"There is no other person better than the Defence Minister (Parrikar) to give OROP as he was in favour of our demand. But ultimately he was pressurised by corrupt people in Cabinet.

"The government has reduced OROP to writing. I am ashamed to say that after having committed to give OROP, the prime minister says that he has not understood the issue," the noted lawyer said at a press conference organised by ex-servicemen at Jantar Mantar.

When asked about the agitation's future course of action, Jethmalani, who is giving legal support to the movement, refused to elaborate further. "There is no need to go to court. The Bihar electoral lesson has taught him a lesson and Modi is not ready for any such defeats. I am not going to spell out my legal strategy," he said.

Jethmalani, who has been a vocal critic of the government over the black money issue, also claimed that Germany had a list of around 1,400 names, majority of which were Indians, but the government did not approach the country for the list.

"The Germans say India is yet to approach them for the list," he said.

Meanwhile, the protesting veterans have announced a Sainik Akrosh Rally at Jantar Mantar on 13 December to press their demand for implementation of OROP.

The United Front of Ex-Servicemen (UFESM), an umbrella organisation spearheading the protest, has also recommended Justice RM Lodha to chair the one-man judicial commission to look into the concerns of the veterans.

The government came out with a notification on OROP on 7 November but the veterans still remain unsatisfied. They have demanded that OROP should be implemented from 1 April, 2014 and not 1 July, 2015 as in the government notification.

"OROP principle is in perpetuity and cannot be fiddled with. The Seventh Central Pay Commission is over and above the OROP.

"Soldiers taking pre-mature retirement after 7 November will not be entitled for the OROP, which is not good for the armed forces as this will result in old army and a war cannot be fought with army of old soldiers. This clause should be removed," Major General (retd.) Satbir Singh, chairman of UFESM, said.

LT COL INDERJIT SINGH'S STRUGGLE                                    FOR 

                                OROP

Service Background

Lt Colonel Inderjit Singh was commissioned into 9 Grenadiers in 1956, served later in 4 Grenadiers. While there he passed his Staff College as one of the toppers and was posted as Brigade Major which is one of the most prestigious Staff appointments. He then commanded 14 Grenadiers. In 1971 he fought a very grim battle. After his Command he was posted to Army HQ where he for some time wrote Tactical Doctrines for the Army and then controlled the foreign training of the Army. He took pre mature retirement from the Army in 1978.

First Memorandum

In 1981 formed an organisation called the All India Ex-Services Welfare Association (AIEWA) and on February 22, 1982 presented their five basic demands to Indira Gandhi. The demands were - removal of disparities in pensions of old and new pensioners (It was given the name of OROP by the HLC of 1984), guaranteed employment up to the age of 58 years,

pre 1964 pensioners widows to be given proper family pensions, restoration of commuted value of pension after the commuted period is over and vacation of lands and houses if occupied by tenants at the time of retirement

High Level Committee,

In Aug 1983, when we threatened 10000 medals return to President of India on 15 Aug 1983, Smt Indira Gandhi set up a High Level Committee (HLC). Lt Col Inderjit Singh was its special Invitee The HLC gave 68 recommendations. In 1984, the report was presented and after two days, Indira Gandhi was shot dead,

The Govt accepted 52 recommendations but the16 most important recommendations were rejected.

Indefinite Fast

On February 25, 1987, Lt Colonel Singh sat on indefinite fast with his five colleagues. On the fourth day of the fast, the government sent a letter increasing the pension from Rs 150 to Rs 375. On 7th day they sanctioned pension for pre 1964 widows of ex servicemen. On tenth day they restored the commuted pension after 15 years. Every time this favour was done it accompanied with a request to give up fast which was rejected.

On the 16th day of the fast, he collapsed and passed out. He was admitted to Wellington hospital in Delhi. He was revived after four hours effort by Doctors. The fast was called off on the 17th day by the direct intervention of the PM Sh Rajiv Gandh. Meetings were fixed for him with the then Defence Minister Sh VP Singh. By the time we got him to accept OROP he was removed as RM on account of Bofors.

High Level Empowered Committee (HLEC)

Then came the PV Narasimha Rao Government under whom

a High Level Empowered Committee (HLEC) was formed with five ministers, six MPs, three defence veterans including Lt Col Singh. and headed by Sh Sharad Pawar with Dr Man Mohan Singh the FM as member. "The committee was inclined to give OROP but could not do so because of the bad economic state in which we had to send our gold to UK to run the country. Despite that it gave very good award but bureaucrats ruined it completely.

Fifth Central Pay Commission

Lt Colonel Singh then prepared himself to tackle the Fifth Central Pay Commission which was soon due. A very strong representation was made to the PC. As a result PC accepted OROP. While implementing the bureaucrats short changed us by granting modified parity to Armed Forces and applied it for themselves too.

CPC Report Rejected

We rejected the CPC Report. He again launched protest Rally on August 22 1997. The PM Sh IK Gujral called Lt Col Inderjit Singh for a meeting in which he promised to come back after examining it. The rally continued for 107 days at Red Fort supported by 23 Chiefs, Vice Chiefs and Army commanders of all the three forces. On 03 Nov PM Mr Gujral deputed Defence Secretary with full mandate to accept three or four of our demands for approval by the Cabinet. Others could follow in the normal course. Meeting was held and following four demands accepted for Cabinet approval:-

a) OROP

b) Removal of 33 years Conditionality for grant of 50 % pension.

c) New Disability rules to be made applicable to the Armed Frces

d) Two pensioners widow to get two pensions.

The Defence Secretary asked Lt Col Inderjit Singh to work out a paper which could be put up to Cabinet. The paper was prepared and given to him next day. This the bureaucrats did not put up to the Cabinet till the Govt fell.

Meeting With The PM

Then came BJP Govt. We tackled the RM to begin with. When that did not work we met Sh Atal Bihari Vajpayee with our seven demands. He accepted three of them, for four which included OROP he appointed RM's Committee. This Committee rejected all four demands and then RM conveyed this decision to us through a letter.

Rally at Ram Lila Ground

Held another Rally at Ram Lila ground and called Sh Madan Lal Khurana, Chairman of Standing Committee of the Parliament on Defence. Conveyed our disgust to him. He then promised to invite Lt Col Inderjit Singh to Parliament to understand the problem and help.

On April 21, 2003, Lt Colonel Singh made presentation in Parliament which resulted in a brilliant report of the Defence Committee. This was again rejected by bureaucrats.

Grant of OROP

In 2004, the Congress formed the government and the Parliamentary Standing Committee Chairman called Lt Colonel Singh. A Group of Ministers under Pranab Mukherjee was appointed. He first promised to invite Col Singh before giving its award and then reneged from doing so. In this desperate situation we met Smt Sonia Gandhi for help. She ordered the RM to do the needful. On 25 Jan 2006 this Committee gave full parity with Fifth CPC rates to JCOs and Jawans. Which was OROP.

Sixth CPC Report

Then came Sixth CPC Report in 2009. We went to Sh AK Antony the RM demanding maintenance of full parity with Sixth CPC rates. He confirmed vide his DO letter to Col Inderjit Singh that he has directed the MOD to give full parity to Armed Forces. Which is OROP. Then some of us burnt Sonia Gandhi's effigy and urged Veterans to support BJP during elections. The Govt then pulled back their hand.

Other Measures

Our efforts continued. On 14 Feb 2014 Sh Rahul Gandhi met Vaterans in Delhi. Col Inderjit Singh presented him the Memorandum. While doing so told him that he was privileged to present the same to his father Sh Rajiv Gandhi on 22 Feb 1982. He was pleased to know this and promised to solve the problem. On 17 Feb 2014 his Govt announced the grant of OROP in the Parliament.

Conclusion

The 34-year long fight for One Rank One Pension started by Colonel Inderjit Singh is still continuing with defence veterans out on streets of the national capital demanding their rights.

Dear Friends,

1.         You are aware that the Govt Notification issued on 07^th Nov 15 regarding Implementation of OROP has serious shortcomings and if implemented, it will totally kill approved OROP Definition. The bureaucrats and the Govt will systematically downgrade the provisions of OROP and finally totally deny us the same.

2.         The 7^th CPC recommendations have come as further blow to already downgraded, degraded, ill-treated, mistreated Military in status, pay and allowances. Our top scales have been depressed, thereby further downgrading the Military. It is intriguing, surprising and totally unfair and unjustified that no member from Defence Forces was included in the 7^th CPC in spite of the issue having been taken up by our service Chiefs. Ignoring their strong recommendations was a grave wrong and unjustified decision of the Govt.

3.         You are all aware that the present Govt also continued the legacy of previous Govts of downgrading the Military on the behest of bureaucracy. PM himself assured us at Rewari and many other locations across the country including at Siachen and at Sea on board the INS Vikramaditya that Actual OROP will be implemented. Unfortunately, the Notification of 07^th Nov 2015 totally belies that assurance. It is a betrayal of faith of Soldiers. Despite our repeated requests for a delegation meeting, PM has not granted us the meeting.

4.         We are all shocked and anguished to read that the RM has now directed Directorate of the Ex-Servicemen Welfare (DESM) to launch a Media Campaign against the Soldiers on Protest Movement demanding correct implementation of OROP as per the Govt approved definition.

5.         Friends, we are in our 170^th Day of Protest at Jantar Mantar and at many other locations in the Country. It is Now or Never. We have decided to intensify our Protest Movement across the Country by holding Rallies and informing the people of our Great Bharat about the injustices being inflicted on the soldiers by successive Govts.

6.         Friends, the Govt has vast resources to supress the Protest Movement. We request the Defence Fraternity and the people of India to join the struggle against the unjustified ill-treatment of Military. This will seriously affect the National security. Some of you may not be aware that from 2006 to 2009, 40% of authorised vacancies at IMA and OTA were not subscribed (Lok Sabha Reply by RM).

7.         Soldiers retire early and also die early vis-a-vis the other Central Govt employees as revealed by a Study carried out by the Govt. The Govt has not addressed these serious factors of Defence Personnel This is the Situation and Time that we need to stand up and demand restoration of status of Military as existed on 26 Jan 1950 in all respects.

8.         Friends, in order to take important decisions together, “SAINIK AAKROSH RALLY” is being held at Jantar Mantar on 13 Dec 2015 from 10AM to 3PM.

9.         The Complete Defence Fraternity and our Civilian Supporters are requested to join in large numbers to make this Rally a Grand Success. Our AIM is to get actual OROP implemented by the government.

10.       We specially appeal to our Retired Chiefs, Army Cdrs, Corps Cdrs and PSOs at the three Service HQs to attend the AAKROSH RALLY at Jantar Mantar on 13^th Dec 2015.  Your soldiers are waiting for your expression of solidity of their cause.  The Civil Military Relations and statues of Military viz the Civilian Counterparts have to be brought back to where these existed as on 26 Jan 1950. 

11.       Retired Chiefs are requested to jointly write to PM for the correct Implementation of sanctioned OROP as per the approved definition without any dilution.  The Notification of 7^th Nov 2015 needs to be amended after resolving all the seven anomalies which have already been pointed out to the Govt.

All veterans know that Ex Servicemen have foughtfor thirty years for One Rank One Pension. NDA Government has accepted the definition of OROP in Parliament. Government has issued notification for OneRank One Pensionon 7 Nov 2015. Government has instituted some conditions in the notification for OROP. The notification completely destroys the definition of OROP. It is tantamount to OROP to ExServicemen without soul. United Front of Ex Servicemen (UFESM) and all veterans thank Prime Minister and NDA government for approving One Rank One Pension but request that these anomalies need to be rectified at the earliest to convince that NDA sincerely wishes to give OROP as per definition.

UFESM has discontinued fast Unto Death since 6^th Sep, in honor of PM for approving OROP but RHS will continue at Jantar Mantar because some Issues are still to be resolved to make this as full OROP. These are -

Ø As per notification OROP will be implemented from 1 July 2014 as against 1 Apr 2014. Please note that all provisions in budget are applicable from 1 Apr of that year.

Ø As per notification Government intends to give basic of calender year 2013 for fixing of basic pension for past pensioners. This will destroy the definition of OROP on its inception itself AND HENCE NOT ACCEPTABLE

Ø As per governmentnotification pension will be fixed as per mean of Max and Min pension for the year 2013. This will violate the basic definition of OROP and hence NOT ACCEPTABLE.

Ø Government wants to equalize pension of pensioners every five years as against one year as per definition. This will again destroy definition of OROP as a senior ranking soldier will get fewer pensions than his junior rank soldier for five years. It will mean ONE RANK FIVE PENSIONS AND HENCE IS NOT ACCEPTABLE.

Ø Government wishes to form one judge committee to adjudicate any anomalies experienced in executing the OROP.UFESM has requested for five member committee with three members Ex Servicemen community as its members.

Ø As per press release ESM who have taken VRS after 7 Nov 2015 will not be eligible for OROP. This will result in armed forces having personnel who have been superseded but cannot leave army. This will leave army with old soldiers in army and will have adverse effect on security of India.All personnel who have taken Pre Mature Pension and will beeligible for pension must be included for OROP

Sainik AAKROSH Rally has been organized on 13^thDec 2015 Sunday from 10 am to2 pm at JantarMantar Delhi. Rally will be presided over by Col Inderjit Singh Chairman UFESM and Chairman AIEWA and Maj Gen Satbir Singh Advisor UFESM and Chairman IESM.

Government has shortchanged ex-servicemen by changing definition of OROP and it cannot be accepted by 28 lac ex-servicemen. Government has refused to rectify anomalies pointed out by ex-servicemen agitating at JM for last 170 days. Announcement of one judge committee to adjudicate issues intentionally introduced in the notification is a planned strategy on part of Government to deny justice to ex-servicemen.

TIME HAS COME TO MAKE FINAL PUSH FOR OUR RIGHT OF OROP. EX-SERVICEMEN IT IS NOW OR NEVER PLEASE COME IN LARGE NUMBERS FOR THE RALLY TO CONVEY YOUR REJECTION OF NOTIFICATION FOR OROP.

COME ONE AND COME ALL TO SHOW YOUR SOLIDARITY FOR YOUR DEMAND OF OROP.

OROP KRANTI :: Status of agitation at JM and OROP. Sainik Aakrosh Rally at JM

Dear Veterans

Many mails are floating in the environment and creating confusion. Time has come to put all rumours to rest and clear the air. 

1. Agitation at JM for OROP; Ex-servicemen are agitating at JM since 15 June 2015. Today is 170  th day of agitation. ESM from 21 states have been visiting JM and observing RHS. There are days when we had more than 100 ESM sitting on RHS. It speaks volumes about the support JM is getting from ESM from all over India. It does not end in India, JM is getting support from ESM settled around the globe. Our friends have been visiting JM in support of OROP and contributing large amounts to offset the expenditure at JM. Our register shows that more than 10000 ESM have already visited JM in support of OROP. 
2. Planning and Execution of RHS at JM; Agitation at JM was planned by IESM in May 2015. It is only IESM and AIEWA have been managing the agitation and RHS since 15 June 2015. 
3. Bank Account of IESM; There is no doubt that Bank account of IESM has been blocked for debit facility. Complete environment knows who has blocked our account and why it has been blocked. The account has been blocked on the letter of Lt Gen Raj Kadyan dated 22 May 2015 to HDFC bank. The account has been blocked just prior to rally planned on 14 June 2015 and beginning of RHS from 15 June 2015. The aim was to ensure that rally and RHS does not become successful. One cannot forget the meeting on 6 June of UFESM in constitution hall in which all members supported the rally and RHS except Lt Gen Raj Kadyan. On whose behalf this plan was made is left for your imagination. Veterans who visited JM in support of RHS realized that it would be well nigh impossible to sustain this satyagruh at JM in support of OROP and decided to contribute to meet the exp of JM. Veterans gave contribution in cheques in account of IESM, however some veterans realised that these cheques cannot be cashed hence they decided to contribute in cash at JM for  IESM. IESM is thankful to veterans, NDA courses and regiments for contributing funds and helping IESM to run the satygruh.
4. Accounts at JM; Some of our detractors who have never visited JM or in any way connected with the satyagruh or fight for OROP have been spreading rumours that unaccounted funds have been received at JM. The question is why are they so much bothered about the satyagruh being planned and executed by IESM, AIEWA and UFESM. If they sincerely want to help ESM then they should be joining JM or they can fight for OROP in their own way. But IESM is very sorry to note that they have been more concerned about the funds at JM. They seem to have no other work than to spread rumours about fund collection at JM by IESM. IESM has stated on many occasions that every penny at JM has been recorded and is accounted for. Still for the sake of mischief mongers IESM will place on record that Rs 1 crore has been received in IESM bank (despite account been blocked) and about Rs 70 lacs have been received in cash at JM. Funds received in bank have been invested in Fixed Deposit and funds received in cash are being used to meet expenditure at JM. IESM hopes that this will put all rumours to rest. 
5. Expenditure at JM; Approximately Rs 30000/ per day is the expenditure at JM to run the satyagruh. Apart from this exp is met for rallies all over India. So for IESM has had rallies at Delhi (two rallies), Ambala (two rallies), Gujrat six rallies, Him Pradesh six rallies, Ludhiana, Fatehgarh sahib, Nagpur, Pune, Kolhapur, Nashik and Mumbai. Apart from the rallies various events have been organised to attract media and these are Kavi sammelan, Kargil Vijay divas run (about 800 civ and soldiers took part in it), candle marches at India gate and medal deposit in various towns in India. Infact we are running out of cash at JM and will again make an appeal to veterans to help us in maintaining JM and to meet the exp of forth coming rally on 13 Dec 15 and many other rallies planned around the country. IESM also arranged many press conferences at JM, Ambala Maharashtra, Punjab and Patna to support the satyagruh.
6. Status of UFESM; All veterans are witness to the satyagruh going on at JM since 14 Junerally and RHS from 15 June 15 under the banner of UFESM. Even Government forces that is police and NDMC attacked ESM on  the satyagruh at JM on 14 Aug to dissuade/force the veterans to close the satyagruh. But brave soldiers fought the police and finally Government had to withdraw this illegal order. Original UFESM is observing RHS at JM and will continue your fight for OROP. We have met RM number of times and conveyed to Government our concerns that the notification issued by Government has four major anomalies and three associated anomalies. UFESM has requested Government to remove these anomalies at the earliest as these anomalies completely destroy definition of OROP. 
7. Notification for OROP; Notification for OROP was issued on 7 Nov 2015 by MOD/ DESW.This notification has seven serious anomalies (four major anomalies directly affecting OROP and three associated anomalies indirectly affecting OROP fixation). UFESM has requested the RM in various meetings that notified OROP with these anomalies is like a body without soul.These anomalies need to be removed for OROP to be real OROP as defined by Koshiari committee and as approved by two Parliaments. UFESM has also requested that Government claim, that expenditure on OROP will rise astronomically with OROP, is incorrect. Government fails to explain the arithmetic of their calculations. This steadfast refusal on part of Govt to give calculation for OROP is puzzling India because Government is refusing to explain the astronomical rise in expenditure on account of NFU, which was granted to all class A serviced in 6 CPC. This favored treatment to class A services and stepchild treatment to Armed Forces is difficult to digest by an honest Indian.
8. Appointment of One Judge Commission; It is surprising and probably has happened for first time that Government has appointed a commission along with notification issued for OROP. This is clear admission of Government that the notification is faulty and will be objected by ESM. Our suspicion that this commission has been issued to circumvent the opposition of notification by ESM. This commission will not have any rep of veterans, its time will keep increasing from six months to one yr and then may be two yrs. God only knows whether its recommendation will ever by accepted or not. Because if the Government is not even ready to explain the arithmetic to ESM how will it accept recommendation of the commission, provided it is favorable to ESM, this itself is very doubtful. So for no committee has ever given judgment in favor of Armed Forces because there is no one in Government to speak for Armed Forces. Govt is yet to issue terms of reference and name of judge for the commission. UFESM very strongly feels that there should be atleast three members from veterans in the commission. The commission should work under commission of inquiries act with a fixed time frame. We recommend Justice Lodha as head of commission, if the commission is unavoidable.
9. Payment for OROP; Government has issued notification for OROP and has decided to start payment for OROP from Jan 16 onwards. ESM above 80 yrs, disabled soldiers and widows will be paid full arrears in one installment whereas other soldiers will be paid arrears in four six monthly installments. Anomalies in execution of OROP will be referred to one judge commission. 
10. UFESM  plan to get full OROP; UFESM plans to fight tooth and nail for correction of anomalies introduced intentionally by Government to spoil the definition of OROP. UFESM will fight the case in Supreme Court as a PIL. There are number of judgments given by Honorable Supreme court in favor of litigants on this issue. Legal luminary Sh Ram  Jethamalani has very kindly consented to take up our case in Honorable Supreme Court. He has been kind enough to take this case Pro-Bono. UFESM is having preliminary meetings with him for preparation of the statement of case. It is for information of all that there is no plan to take stay on the notification issued by the Govt. Hence payment of enhanced pension and arrears due to ESM will be given to all ESM. 
11. Adverse effect on OROP because of ESM are not united; There is no doubt that ESM must unite to create a strong pressure group to convince Government to accede to our legitimate demands.   Some members of original UFESM have separated and made their own organisation for reasons best known to them. ESM must have noticed many mails from splinter gp abusing Jantar Mantar satyagruh to prop themselves up in eyes of environment.But we the orginal UFESM at Jantar Mantar do not believe in abusing our own brothers and comrades and have always stayed away from this kind of criticism and mails. Some ESM get worried to read news about splinter group meeting RM to discuss OROP and are apprehensive that this group might accept diluted form of OROP. Any group which will accept any dilution in definition of OROP will be rejected by the family and hence there is no question of anyone accepting dilution in definition of OROP.   Govt has attempted to create a divide in unity of veterans and has partially succeeded. But it cannot go on for long as ESM all over country will unite soon on common issues. As UFESM see it we have been successful in creating pressure on Govt by agitating at JM. Agitation at JM is causing embarrassment to Govt in India as well as abroad. The party which came to power on pro Armed Forces image is getting labeled as anti Armed Forces party because of their refusal to fulfill their promise and their arrogance to see the point of view of agitating ESM. Now we have two pressure gps working on Govt one from JM agitators and other which is trying to become friendly with Govt. Govt has to listen to the most genuine demand of ESM and grant full OROP sooner than later as demand  of any gp.  
12. SAINIK AAKROSH RALLY ON 13 DEC 2015 AT JM; UFESM has planned SAINIK AAKROSH RALLY at JM from 1000h to 1500h on 13 Dec 2015 SUNDAY to express soldier's anguish with the Govts plan to dilute definition of OROP as given in notification issued on 7 Nove 2015. UFESM requests all ex-servicemen to spread this message to all and join the rally on 13 Dec at JM. This will send a message to Govt that ESM all over India are anguished with this stepchild treatment of Armed Forces and ex-servicemen. Rally is being attended by ESM from 21 states of India. 

I am sure above would more or less satisfy all the questions being raised because of rumours being spread by some disgruntled ESM. 

FRIENDS TIME HAS COME FOR THE LAST HEAVE TO REALIZE OUR DREAM OF OROP. LET US ALL ASSEMBLE AT JANTAR MANTAR IN LARGE NUMBERS TO SEND A STRONG MESSAGE THAT ESM ALL OVER COUNTRY ARE UNITED AND WILL FIGHT FOR THEIR RIGHTS. GOVERNMENTS CANNOT IGNORE US ANYMORE AND WILL HAVE TO OUR GENUINE DEMANDS.
