The one-man Judicial Committee comprising Justice L Narasimha Reddy set up by the Central Government to look into the implementation of “one rank, one pension” (OROP) formula for the ex-servicemen and address anomalies arising thereof held its first public hearing at the Chandimandir Military Station today. Ex-servicemen contended that major points of discord were not included in the committee’s terms of reference.

A large number of retired armed forces personnel across all ranks attended the hearing to present their views and opinions before the committee, which is scheduled to submit its reports to the government in December. Justice Reddy is a former Chief Justice of the Patna High Court.

Ex-servicemen said major points of discord that did not form part of the committee’s mandate included the definition of OROP, not equalising the pension annually, not fixing pension according to the highest rate for the particular rank and instead basing it on the average rate of the rank, fixing the date of implementation and base year for calculations.

Veterans said unless these key issues were resolved, OROP would lose its real essence. It would not only deprive them of full benefits, but also lead to more disparities later on. This, they claimed, would lead to more unrest and bad blood.

Kindly refer to your letter No. dated 02-03-2016 with PCDA(P)Grievance No. G-15880 dated 19/04/2016. In this connection it is intimated the Qualifying service in the
6th CPCCorr PPOwill be issued as under:-
 

 




(1) As per AO 56/2001 para (I) states that in the past there was a provision for counting of pre-commissioned service in the ranks of the Armed Forces and civil department of Govt. of India towards pension of permanent commissioned officer. Prior to 01 July 1966, only one half of such pre-commissioned service was being counted for pension. It was raised to two third
w.e.f. 01/07/1966 and full w.e.f. 01/07/1986.

(2) The issue of counting pre-commissioned service was revised by the fourth central pay commission and Govt. of India issued orders for counting of full pre-commissioned service on or after 01/01/1986, vide Note No.(4) under para 5 of Govt. of India ,Ministry of defence letter No.1(5)/87/D/(Pen/Sers) dated 30/10/1987 which reads as follows.

The weightage is auto calculated as per the table under Cir No. 500. Hence No separate information is required to be given. The same will be available on the Public domain of the PCDA(P) Allahabad/Govt of India letter No.1(6)/1998/D(Pen/Ser) dated 30-20-1998.

Your contention of all the case of pre-01/01/1996 case will be dealt as per order on the subject i.e. Prior to 01/07/1966 Qualifying service of OR will be V2 of the gross OR qualifying service to commission service. After 01/07/1966 and up to 31/12/1985, 2/3rd of the qualifying service, and from 01/01/1986 full qualifying service will be added to the commissioned service.
In your case you have retired on 10/04/1979. Hence the net qualifying service to be added in the cornrnissioned service is 2/3rd of gross OR service (i.e. 2/3rd of 07years 05 month ll days= 4 years ll month 21days)

 Defence Minister Manohar Parrikar was in favour of granting 'One Rank, One Pension' (OROP) to ex-servicemen but pressure was exerted on him by his Cabinet colleagues on the issue, legal luminary Ram Jethmalani on Monday claimed even as he launched a scathing attack on Prime Minister Narendra Modi.
Jethmalani, a supporter-turned-critic of Modi and a former BJP leader, said apart from failing to deliver on his electoral promise of bringing back black money stashed abroad, Modi has not been able to deliver on the OROP issue.

Ex-servicemen have been staging protests at Jantar Mantar in New Delhi for the past 176 days, demanding OROP.
"There is no other person better than the Defence Minister (Parrikar) to give OROP as he was in favour of our demand. But ultimately he was pressurised by corrupt people in Cabinet.
"The government has reduced OROP to writing. I am ashamed to say that after having committed to give OROP, the prime minister says that he has not understood the issue," the noted lawyer said at a press conference organised by ex-servicemen at Jantar Mantar.
When asked about the agitation's future course of action, Jethmalani, who is giving legal support to the movement, refused to elaborate further. "There is no need to go to court. The Bihar electoral lesson has taught him a lesson and Modi is not ready for any such defeats. I am not going to spell out my legal strategy," he said.
Jethmalani, who has been a vocal critic of the government over the black money issue, also claimed that Germany had a list of around 1,400 names, majority of which were Indians, but the government did not approach the country for the list.
"The Germans say India is yet to approach them for the list," he said.
Meanwhile, the protesting veterans have announced a Sainik Akrosh Rally at Jantar Mantar on 13 December to press their demand for implementation of OROP.
The United Front of Ex-Servicemen (UFESM), an umbrella organisation spearheading the protest, has also recommended Justice RM Lodha to chair the one-man judicial commission to look into the concerns of the veterans.
The government came out with a notification on OROP on 7 November but the veterans still remain unsatisfied. They have demanded that OROP should be implemented from 1 April, 2014 and not 1 July, 2015 as in the government notification.
"OROP principle is in perpetuity and cannot be fiddled with. The Seventh Central Pay Commission is over and above the OROP.
"Soldiers taking pre-mature retirement after 7 November will not be entitled for the OROP, which is not good for the armed forces as this will result in old army and a war cannot be fought with army of old soldiers. This clause should be removed," Major General (retd.) Satbir Singh, chairman of UFESM, said.

Service Background

Lt Colonel Inderjit Singh was commissioned into 9 Grenadiers in 1956, served later in 4 Grenadiers. While there he passed his Staff College as one of the toppers and was posted as Brigade Major which is one of the most prestigious Staff appointments. He then commanded 14 Grenadiers. In 1971 he fought a very grim battle. After his Command he was posted to Army HQ where he for some time wrote Tactical Doctrines for the Army and then controlled the foreign training of the Army. He took pre mature retirement from the Army in 1978.

First Memorandum
In 1981 formed an organisation called the All India Ex-Services Welfare Association (AIEWA) and on February 22, 1982 presented their five basic demands to Indira Gandhi. The demands were - removal of disparities in pensions of old and new pensioners (It was given the name of OROP by the HLC of 1984), guaranteed employment up to the age of 58 years,

pre 1964 pensioners widows to be given proper family pensions, restoration of commuted value of pension after the commuted period is over and vacation of lands and houses if occupied by tenants at the time of retirement

High Level Committee,
In Aug 1983, when we threatened 10000 medals return to President of India on 15 Aug 1983, Smt Indira Gandhi set up a High Level Committee (HLC). Lt Col Inderjit Singh was its special Invitee The HLC gave 68 recommendations. In 1984, the report was presented and after two days, Indira Gandhi was shot dead,
The Govt accepted 52 recommendations but the16 most important recommendations were rejected.


Indefinite Fast

On February 25, 1987, Lt Colonel Singh sat on indefinite fast with his five colleagues. On the fourth day of the fast, the government sent a letter increasing the pension from Rs 150 to Rs 375. On 7th day they sanctioned pension for pre 1964 widows of ex servicemen. On tenth day they restored the commuted pension after 15 years. Every time this favour was done it accompanied with a request to give up fast which was rejected.

On the 16th day of the fast, he collapsed and passed out. He was admitted to Wellington hospital in Delhi. He was revived after four hours effort by Doctors. The fast was called off on the 17th day by the direct intervention of the PM Sh Rajiv Gandh. Meetings were fixed for him with the then Defence Minister Sh VP Singh. By the time we got him to accept OROP he was removed as RM on account of Bofors.

High Level Empowered Committee (HLEC)
Then came the PV Narasimha Rao Government under whom
a High Level Empowered Committee (HLEC) was formed with five ministers, six MPs, three defence veterans including Lt Col Singh. and headed by Sh Sharad Pawar with Dr Man Mohan Singh the FM as member. "The committee was inclined to give OROP but could not do so because of the bad economic state in which we had to send our gold to UK to run the country. Despite that it gave very good award but bureaucrats ruined it completely.

Fifth Central Pay Commission
Lt Colonel Singh then prepared himself to tackle the Fifth Central Pay Commission which was soon due. A very strong representation was made to the PC. As a result PC accepted OROP. While implementing the bureaucrats short changed us by granting modified parity to Armed Forces and applied it for themselves too.

CPC Report Rejected
We rejected the CPC Report. He again launched protest Rally on August 22 1997. The PM Sh IK Gujral called Lt Col Inderjit Singh for a meeting in which he promised to come back after examining it. The rally continued for 107 days at Red Fort supported by 23 Chiefs, Vice Chiefs and Army commanders of all the three forces. On 03 Nov PM Mr Gujral deputed Defence Secretary with full mandate to accept three or four of our demands for approval by the Cabinet. Others could follow in the normal course. Meeting was held and following four demands accepted for Cabinet approval:-

a) OROP
b) Removal of 33 years Conditionality for grant of 50 % pension.
c) New Disability rules to be made applicable to the Armed Frces
d) Two pensioners widow to get two pensions.

The Defence Secretary asked Lt Col Inderjit Singh to work out a paper which could be put up to Cabinet. The paper was prepared and given to him next day. This the bureaucrats did not put up to the Cabinet till the Govt fell.


Meeting With The PM
Then came BJP Govt. We tackled the RM to begin with. When that did not work we met Sh Atal Bihari Vajpayee with our seven demands. He accepted three of them, for four which included OROP he appointed RM's Committee. This Committee rejected all four demands and then RM conveyed this decision to us through a letter.

Rally at Ram Lila Ground
Held another Rally at Ram Lila ground and called Sh Madan Lal Khurana, Chairman of Standing Committee of the Parliament on Defence. Conveyed our disgust to him. He then promised to invite Lt Col Inderjit Singh to Parliament to understand the problem and help.

On April 21, 2003, Lt Colonel Singh made presentation in Parliament which resulted in a brilliant report of the Defence Committee. This was again rejected by bureaucrats.

Grant of OROP
In 2004, the Congress formed the government and the Parliamentary Standing Committee Chairman called Lt Colonel Singh. A Group of Ministers under Pranab Mukherjee was appointed. He first promised to invite Col Singh before giving its award and then reneged from doing so. In this desperate situation we met Smt Sonia Gandhi for help. She ordered the RM to do the needful. On 25 Jan 2006 this Committee gave full parity with Fifth CPC rates to JCOs and Jawans. Which was OROP.

Sixth CPC Report
Then came Sixth CPC Report in 2009. We went to Sh AK Antony the RM demanding maintenance of full parity with Sixth CPC rates. He confirmed vide his DO letter to Col Inderjit Singh that he has directed the MOD to give full parity to Armed Forces. Which is OROP. Then some of us burnt Sonia Gandhi's effigy and urged Veterans to support BJP during elections. The Govt then pulled back their hand.

Other Measures
Our efforts continued. On 14 Feb 2014 Sh Rahul Gandhi met Vaterans in Delhi. Col Inderjit Singh presented him the Memorandum. While doing so told him that he was privileged to present the same to his father Sh Rajiv Gandhi on 22 Feb 1982. He was pleased to know this and promised to solve the problem. On 17 Feb 2014 his Govt announced the grant of OROP in the Parliament.

Conclusion
The 34-year long fight for One Rank One Pension started by Colonel Inderjit Singh is still continuing with defence veterans out on streets of the national capital demanding their rights.

Dear Friends,
1.         You are aware that the Govt Notification issued on 07th Nov 15 regarding Implementation of OROP has serious shortcomings and if implemented, it will totally kill approved OROP Definition. The bureaucrats and the Govt will systematically downgrade the provisions of OROP and finally totally deny us the same.
2.         The 7th CPC recommendations have come as further blow to already downgraded, degraded, ill-treated, mistreated Military in status, pay and allowances. Our top scales have been depressed, thereby further downgrading the Military. It is intriguing, surprising and totally unfair and unjustified that no member from Defence Forces was included in the 7th CPC in spite of the issue having been taken up by our service Chiefs. Ignoring their strong recommendations was a grave wrong and unjustified decision of the Govt.
3.         You are all aware that the present Govt also continued the legacy of previous Govts of downgrading the Military on the behest of bureaucracy. PM himself assured us at Rewari and many other locations across the country including at Siachen and at Sea on board the INS Vikramaditya that Actual OROP will be implemented. Unfortunately, the Notification of 07th Nov 2015 totally belies that assurance. It is a betrayal of faith of Soldiers. Despite our repeated requests for a delegation meeting, PM has not granted us the meeting.
4.         We are all shocked and anguished to read that the RM has now directed Directorate of the Ex-Servicemen Welfare (DESM) to launch a Media Campaign against the Soldiers on Protest Movement demanding correct implementation of OROP as per the Govt approved definition.
5.         Friends, we are in our 170th Day of Protest at Jantar Mantar and at many other locations in the Country. It is Now or Never. We have decided to intensify our Protest Movement across the Country by holding Rallies and informing the people of our Great Bharat about the injustices being inflicted on the soldiers by successive Govts.
6.         Friends, the Govt has vast resources to supress the Protest Movement. We request the Defence Fraternity and the people of India to join the struggle against the unjustified ill-treatment of Military. This will seriously affect the National security. Some of you may not be aware that from 2006 to 2009, 40% of authorised vacancies at IMA and OTA were not subscribed (Lok Sabha Reply by RM).
7.         Soldiers retire early and also die early vis-a-vis the other Central Govt employees as revealed by a Study carried out by the Govt. The Govt has not addressed these serious factors of Defence Personnel This is the Situation and Time that we need to stand up and demand restoration of status of Military as existed on 26 Jan 1950 in all respects.
8.         Friends, in order to take important decisions together, “SAINIK AAKROSH RALLY” is being held at Jantar Mantar on 13 Dec 2015 from 10AM to 3PM.
9.         The Complete Defence Fraternity and our Civilian Supporters are requested to join in large numbers to make this Rally a Grand Success. Our AIM is to get actual OROP implemented by the government.
10.       We specially appeal to our Retired Chiefs, Army Cdrs, Corps Cdrs and PSOs at the three Service HQs to attend the AAKROSH RALLY at Jantar Mantar on 13th Dec 2015.  Your soldiers are waiting for your expression of solidity of their cause.  The Civil Military Relations and statues of Military viz the Civilian Counterparts have to be brought back to where these existed as on 26 Jan 1950. 
11.       Retired Chiefs are requested to jointly write to PM for the correct Implementation of sanctioned OROP as per the approved definition without any dilution.  The Notification of 7th Nov 2015 needs to be amended after resolving all the seven anomalies which have already been pointed out to the Govt.
