Dear Chiefs,
1. More than 40 anomalies of 6th CPC had not been resolved. The 7th CPC has further degraded/downgraded Military. In this connection following are enclosed herewith:-
(a) Our first comments are as per our letter dated 20 Nov 2015 circulate to all veterans as per Appendix A attached.
(b) Anomalies as per Appendix B attached.
(c) OROP Denied by 7 CPC as per Appendix C attached.
2. There is an urgent need to take up strongly all these issues with the PM/RM and have these resolved. The profession of Arms is already not a proffered option for the youth. 40 percent vacancies in IMA & OTA were not subscribed from 2006 -2009 (Reply in Parliament), as per Appendix D attached. Unattractive package along with the continuous degradation and downgradation will adversely affect the choice of youth for the Profession of Arms.
3. May we request you to have the anomalies of 7th CPC alongwith the existing ones taken up strongly with the Govt for suitable resolution? You are the present baton holders and we look up to you for our welfare and resolution of issues adversely affecting us. While, the other democracies have Covenant Acts for the Defence Forces, to give them the status of preferred Citizen and a Life of Dignity & Respect, we in India have no such Covenant Act. Hope we also have such Acts framed by the Parliament earliest. We cannot afford to remain in this situation and status. Urgent and surgical measures are necessary.

7TH PAY COMMISSION REPORT
Dear Friends,
1. Our initial comments:-
- Unfair to Defence Pers. Def Forces have been further degraded and downgraded.
- Edge required to be given to Defence Forces over other Services in basic pay has not been given. Other democracies pay 15 -25% additional basic pay to Defence Personnel.
- Our differential in pension which existed in 1973 ie Pension 70-75% of LPD for JCOs & ORs & 50% of LPD for Officers, while for Civilians it was 33% has not been restored. This differential should have been mentioned by the 7th CPC which has not been done. Accordingly, the Pension of JCOs & ORs should be 90% of LPD and for Officers it would be 70%.
- MSP worked out and recommended by the three Services HQ and ESM was 62% of basic pay for JCOs & ORs and 52% of basic pay for Officers based on various factors. The MSPs recommended is too less to what has been worked out.
- The pay of the Defence Personnel as worked out by one of our expert Wing Cdr Arvind Vig is less than the Civilian Counter parts where as it should have been 20-25% more. The details are as under:-
- Defence Disability pension has been moved from percentage of last pay drawn to a fixed slab, which will result in a substantial reduction, for officers resulting in getting lower DP from the present. The babus are upto their DIRTY TRICKS AGAIN…
- Facility of free ration to officers in Peace Station has been withdrawn. In terms of funds every Officers has been put to disadvantage to the tune of monthly rates of rations.
- OROP for all other Services will further downgrade Military. Either other Services must be brought to the Terms and Conditions of Service of Defence Personnel or Defence Personnel be given same term and conditions of Service as other Services before OROP is given to all other services.
2. Friends above disadvantages to Defence Forces is directly attributed to the absence of Military Members in the CPC. Our Chiefs had strongly asked for the same which was not accepted. What a machination by the bureaucracy?
3. Our detailed comments will be info to all after the 7th CPC Recommendation have been studied and analysed in detail in a few days’ time.
4. We are pressing on with our Protest Movement at Jantar Mantar and elsewhere in the Country and intensifying it further to get Justice to Defence Fraternity. OROP Notification of 7th CPC needs to modified after removing the seven shortcomings and fresh Notification issued. We have requested for meeting with Hon’ble Prime Minister and Raksha Mantri. Hope we get it to resolve the shortcomings. We are in our 159th Day of our Protest Movement.

Appendix B
UNJUSTIFIED SHOCKERS FOR DEFENCE & JUSTIFIED BONANZA FOR POLICE, THANKS TO THE 7TH PAY COMMISSION
1. Top end of basic pay of defence personnel has been depressed. (Earlier it was equal for the defence and the civilian counterparts.)
2. Demand for 75% last pay drawn as pension has been rejected by saying that the MSP counts for pension. (P 402)
3. Furlough leave and free ration to defence officers to be abolished.
4. 100 units of free electricity to defence personnel to be abolished.
5. Funeral allowance to defence personnel to be abolished.
6. Technical pay tier 2 for defence officers abolished (No change in technical pay tier 1). Flight charge certificate allowance abolished. P 245
7. Option given to defence staff to join NPS. (P 398). Defence personnel should contribute for their pensions. (P399.)
8. Demand for Upgradation of Group X Sgts/Havildars to diploma pay scale rejected.
9. COBRA allowance for Police Forces brought at par with Special Forces Allowance for defence personnel.
10. Ex-gratia allowance for police forces enhanced and brought at par with those for defence personnel.
11. One additional free railway warrant to be given to police forces in hard areas on the pattern of defence forces.
12. Military Service Pay of defence personnel not to count for HRA and transfer grant.
13. Gallantry award monthly allowance enhanced for Coast Guard. No change for defence gallantry awards.
14. Special duty allowance for the IAS/IPS at 30 % of basic pay to far exceed the Siachen/submarine/flying allowance. A Joint Secretary drawing basic pay of Rs 182700 will get this allowance while getting posted in North-East/Ladakh as Rs54810 whereas the Siachen/flying/submarine allowance has been capped at Rs 31500.
15. Return to slab based disability pension system may not be beneficial. It is likely to result in a substantial reduction
16. MSP worked out and recommended by the three Services HQ and ESM was 62% of basic pay for JCOs & ORs and 52% of basic pay for Officers based on various factors. The MSPs recommended (15500, 10800, 5200, 3600) for commissioned officers, MNS, JCOS/NCOs/ORs, NCs(E) are too less to what has been worked out.
17. One rank, one pension which was the exclusive right of the defence services has now been granted to the civilians including the police forces.
18. Our differential in pension which existed in 1973 ie Pension 70-75% of LPD for JCOs & ORs & 50% of LPD for Officers, while for Civilians it was 33% has not been restored. This differential should have been mentioned by the 7th CPC which has not been done. Accordingly, the Pension of JCOs & ORs should be 90% of LPD and for Officers it would be 70%.
19. Not-so-good intentions! Retiring age of Sepoy has been shown as 42-48, of Naik has been shown as 49 and of Havildaar has been shown as 49, of Nb Sub as 52., of AC/LAC has been shown as 52. P397. P398 says they retire after their term of engagement. It is not mentioned that majority of defence personnel retire at 35.

Dear Veterans,
Many of you might have made some analysis of the 7CPCR and arrived at some conclusions. Brig Jaspal Bhinder has pointed out the anomalous situation wherein a Lt Col is likely get higher pension than that of a Brigadier with more total service. I agree with him in totality. I am working on a detailed brief to highlight the irrationality of the CPCR on pension re-fixation for past pensioners.
2 Just an illustration
Case of Lt Col
a. Option 1 – Existing pension of 26265 multiplied by a factor of 2.57 = 67501.00
b. Option 2
i. Minimum pay in the Matrix 1,16,700.00
ii. NP on adding max of 12 increments @3% 1,66,386.00
iii. Pension including MSP of 15500 90,943.00
Case 2 Brigadier
c. Option 1 – Existing pension of 29145 multiplied by a factor of 2.57 = 74,903.00
d. Option 2
iv. Minimum pay in the Matrix 1,34,400.00
v. NP on adding max of 6 increments @3% 1,60,480.00
vi. Pension including MSP of 15500 87,990.00 lesser than 90,943 the pension of the Lt Col
3 Let us see the possibility of a Brigadier with a total service of 35 to 36 years, retiring with just two increments in the rank of Brigadier
a. Minimum pay in the Matrix 1,34,400.00
b. NP on adding max of 2 increments @3% 1,42,585.00
c. Pension including MSP of 15500 79,042.00
NOTE: There may be some minor differences in the figures arrived at by me, due to difference of approach to rounding off.
4 Thus, you see that pre 2006 veteran of the rank of Lt Col with a total service of even 30 years stands to get a pension of 90943.00, whereas a pre 2006 Brigadier with a total service of as much as 36 years stands to get a pension of 79042.00, lesser by 15.06%, instead of getting higher pension by about the same margin if not more. Please give it a careful scrutiny.
5 Do we call it “Modified Parity” or “Demeaning Disparity”?
Finally a request! I am sure there is likely to be a lot of anomalies in the 7CPCR. Of course, we are yet to know the Government reactions. Yet it may be, in my opinion, prudent to project the anomalies as when noticed to the Government even before they finalize the orders. I intend to work on it. As I am working on my own at my home, I need help from those of you, who have the time and inclination, to point out errors in my analysis.

Appendix "D"

The number of
cadets joining National Defence Academy, Khadakwassla and Indian Military
Academy, Dehradun in 2009 has gone up as compared to last year. In officers
Training Academy there has been a decline. Details for last three years and
current year are as under:-
Government has
taken various steps to encourage the youths to join the Armed Forces. The
details of the measures adopted are as follows:-
(i) Better
pay package as part of 6th Pay Commission;
(ii) Making
Short Service Commission (SSC) attractive through a slew of measures such as;
(1) Grant of ex-servicemen status to all
SSC officers who have completed terms of service;
(2) Provision of Canteen Stores Department (CSD)
facility to the SSC Officers.
(3) Provision of medical facility to all the SSC
Officers after release under Employees Contributory Health Services (ECHS)
scheme.
(iii) The Army has also opened a number of
professional training institutes under the Army Welfare Education Society, to
offer quality professional education to Army children at affordable costs.
(iv) A number of Image Projection campaigns
have been launched by the Recruiting Directorate to attract quality youth to
join the Army;
(v) Enhanced
physical interaction with target audience has been undertaken in which
officers from Recruiting Directorate and teams from Command Headquarters
visit various Universities and Colleges. Publicity Compact Discs (CDs) on
Army as a career have been prepared and projected to target audience through
these teams. Moreover, National Cadet Corps (NCC) units and Recruiting
organizations have also been incorporated to deliver motivational talks in
educational institutions.
(vi) A
proposal to set up another Officers’ Training Academy is under consideration
of the Government
This
information was given by Defence Minister Shri AK Antony in a written reply
to Smt Yashodhara Raje Scindia and Shri Virender Kashyap in Lok Sabha today.
